By accessing this website and purchasing products from Full Time Sailor and its related entities (hereafter FTS), you are agreeing to be bound by these Terms of Use and all applicable laws and regulations.
IF YOU DO NOT AGREE WITH ANY OF THESE TERMS, YOU ARE PROHIBITED FROM AND INFORMED NOT TO USE OR ACCESS THIS SITE NOR TO PURCHASE ANY OF THE PRODUCTS MADE AVAILABLE TO THE PUBLIC BY FTS AND ITS RELATED ENTITIES.
2. Grant of License
- Permission is granted to temporarily download one copy of any downloadable materials on the FTS website for personal, non-commercial private viewing only. This permission is the grant of a license, not a transfer of title, and under this license you may not:
- modify or copy the materials;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- attempt to decompile or reverse engineer any software contained on the FTS website;
- remove any copyright, trademark or other proprietary notations from the materials; or
- transfer the materials to another person or ‘mirror’ the materials on any other server.
- This license shall automatically terminate if you violate any of these restrictions and the License may be terminated by FTS at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
3. Disclaimer/Disclosures
The materials on the FTS website are provided ‘as is’. FTS makes no warranties, expressed or implied about its products viability or the business opportunity and hereby disclaims and negates all warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, FTS does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
4. Limitations
In no event shall the School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the FTS website or use of its training and products. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you and such Jurisdictional choice of laws will prevail.
5. Revisions and Errata
The materials appearing on the FTS website may include technical, typographical, or photographic errors. FTS does not warrant that any of the materials on its web site are accurate, complete, or current. FTS may make changes to the materials contained on its web site at any time without notice. FTS does not, however, make any commitment to update the materials.

FTS has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by FTS of the site. Use of any such linked website is at the user’s own risk.
7. Site Terms of Use Modifications
FTS may revise these Terms of Use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms of Use and you will be responsible to make ongoing and regular review of these terms.
8. Governing Law
Any claim relating to the FTS and its related entities website shall be governed by the laws, venue and Jurisdiction of Salt Lake County, State of Utah, without regard to its conflict of law provisions.
9. Relationship of Parties
It is understood by you that you are a Customer or Licensee only. FTS will not provide any fringe benefits, insurance, vacation or otherwise upon your becoming a member. Any and all of your family, staff employees and associates shall be bound to the same terms as you under this agreement.
10. Consent
Upon purchasing a course from FTS, you consent to receive emails about content updates, promotions, and various other newsletters.

1. Your contract with FTS
Your contract is with FTS. The following Terms and Conditions will be incorporated into every contract between you and FTS. By making a payment you will be accepting the Terms & Conditions for all members of your party and you are therefore advised to read them carefully. The booking will become binding when your first credit card payment is received by FTS.
2. Changes to your course
You are not entitled to change the date and/or type of a course reservation once confirmed. Course type can be changed in accordance with your instructor; this can be done before or during your course. We will not refund any difference in course fee if a cheaper course is decided upon after payment. You will be billed for the difference in course fee if a more expensive course is taken.
3. Cancellations
You may cancel your course at any time subject to the following penalties which are to be paid to us:
At any time, an administration fee of 10% of the total course fee. Between 60 and 46 days before your course: 50% of the total course fee. Less than 46 days before your course: The total course fee.
Cancellations must be notified to us in writing by email. The penalties will be calculated from the date we receive your cancellation.
We may need to cancel a course due to unforeseen circumstances or natural events such as forcé majeur including but not limited to hurricanes and hurricane-affected areas.
If such an occurrence happens we will offer an alternative course but not issue any refunds. In the event that you would like the flexibility to receive a full refund, we recommend you taking out trip insurance.
We reserve the right to cancel a course at any time without reason. If we cancel without reason we shall return all monies paid by you to us in respect of the provision of the course.
4. Deposits
A deposit of at least 50% of the total course fee is required to reserve your place on a course.
5. Payment
All courses must be fully paid for at least 60 days prior to the confirmed start date. FTS will process the fee 60 days prior to the confirmed start date, as specified in the credit card authorisation form or online, which is valid for confirmation of the course.
6. Refund Policy
You can elect to take out travel insurance to cover for cancellation due to weather, Covid and/or other unforeseen circumstances. The choice of a travel insurance company is yours to make. If you do not elect for this additional cover, FTS has a no-refund policy.
7. Legal Obligations
You are solely responsible for complying with all laws, regulations, orders, demands, and requirements of the chosen destination. We shall not be liable in any way whatsoever to you in connection with obtaining necessary documents or complying with such laws, regulations, orders, demands, requirements or instructions, whether given orally or in writing or otherwise, or for the consequences to you resulting from your failure to obtain such documents or to comply with such laws, regulations, orders, demands, requirements or instructions. You should note in particular that no one whose details are not registered on the crew list may be carried aboard. Please note also that you may not remove any items or antiquities from land, beach, or the seabed.
8. Local Government Fees and Charges
Where we include costs for local government fees, we allow for the costs that exist at the time of purchase. If any local government fees change between booking and course, we reserve the right to pass these new fees on to you, without any markup.
9. Travel documents
You are responsible for obtaining and must possess and have available for presentation as required all entry and exit, health and other documents required by laws, regulations, order, demands or requirements of the place where the course takes place. We reserve the right to refuse to provide a course to anyone who has not complied with, or whose documents do not appear to comply with, such applicable laws, regulations, orders, demands or requirements.
10. Yacht Specification
FTS may alter the specification of the yacht if it deems that in its absolute discretion, necessary to either ensure that you gain the maximum benefit from your sailing or to ensure the safety of yourself, other crew members and other water users.
11. Force Majeure
If weather conditions are the reason for postponement then an alternative date(s)/location(s) will be offered, where possible. An alternative date must be accepted within three months from the original date. We do not provide a refund where the weather is the reason for the postponement. Any reasonable increase in cost due to seasonal variations or change in sailing selection will be met by you.
We will always make best efforts to provide courses as published. However, in the event of other force majeure including an act of God, strikes, lockout, an act of Government or any other occurrence beyond our control, FTS will not be liable if prevented from fulfilling its obligations. We recommend travel insurance to mitigate this risk.
We will always endeavour to provide a service of equal quality.
12. Conduct aboard school vessels
If in our reasonable opinion you conduct yourself aboard one of our vessels so as to endanger the vessel or any person or property on board, or behave in a disorderly manner or in a manner to which other clients may reasonably object, we may take such measures as we deem necessary to prevent continuation of such conduct including your removal from the vessel. You may be prosecuted for offenses committed on board a vessel. Furthermore, you agree to abide by the orders of the Skipper/Instructor in command of the school vessel at all times.
You must accept responsibility for the proper conduct of yourself and any members of your party. We reserve the right in our absolute discretion to terminate, without further notice, the sailing arrangements of any client who refuses to comply with the instructions or orders of the skipper or other staff employed by FTS or whose behaviour or competence in their opinion is likely to cause distress, danger or annoyance to their crew, other clients, staff of any third party or property. Upon such termination, our responsibility for your sailing ceases and FTS shall not be liable for any extra costs incurred by you.
13. Photography
FTS instructors and our staff will sometimes take photographs for use in publicity material. If you have any objection to your image being used for this purpose, please inform your FTS instructor or staff when photography takes place.
14. Passing or failing courses
An Instructor and/or Examiner will assess your skill level during the course and with some courses, there will also be a written exam. At the end of the course, your Instructor / Examiner will decide if you have passed or failed. Their decision is final. If, however, you disagree with their decision you may make an application to the school for redress.
15. Complaints
We sincerely hope you will not have a cause for complaint. Should you have a complaint about any aspect of our course or service, please make it known to your Instructor at the time. Any complaint will be taken very seriously. If you are still dissatisfied please let us know in writing via email. We take the quality of our service seriously and will do what we can to remedy the situation.
16. Insurance
You are responsible for ensuring that you have travel insurance, which will cover any luggage, medical expenses and repatriation if necessary, and that this insurance covers you while sailing.
17. Disclaimer
FTS shall not be held liable for death, personal injury, loss or damage to property howsoever arising and therefore by signing the booking confirmation form, you hereby release, to the full extent permitted by state, law and equity, FTS, its employees and agents from all actual and contingent liability in respect of such personal injury, death, loss or damage.
FTS reserves the right to interpret the terms and conditions as it sees fit and to amend them at its discretion.
